Councils should stop automatically triggering child protection enquiries under section 47 of the Children Act 1989 in response to bruising in pre-mobile infants, government advisers have said. The Child Safeguarding Practice Review Panel made the call in a briefing published last week , as research found increasing numbers of authorities had policies that required a section 47 enquiry or a strategy discussion to decide whether such an enquiry should take place, in these cases.

There were almost 250 applications to deprive children of their liberty in England in the first two months of a dedicated court set up to handle these cases. The national DoLs court received 237 applications in July and August to authorise the deprivation of liberty of a child or young person using the inherent jurisdiction of the High Court – which is designed to safeguard vulnerable people where there is no statutory provision to do so.

Their decision to care for a child is often made at times of family crisis, triggering heightened stress and anxiety, with little planning or preparation. They have not made a proactive choice to become a foster carer or adopter, but find themselves in a situation, not of their own choosing, but wishing to safeguard a child they love.

The child entered my office and barely could contain themself. Quickly they told me about their preference of who to live with, given their parents separation. The child went on to explain how the preferred parent was better than the other. Once told, the child settled. I thanked the child and complemented on being able to share their information. Given the abundance of information I asked if either parent helped them remember all the points they shared.
